Mammoth Estates Homeowners Association (HOA) Use of Barbeques and Other Open Flame Devices Rule
Effective Date: October 15, 2025
This rule is adopted by the Mammoth Estates Homeowners Board of Directors as allowed by Covenants, Conditions and Restrictions to

Comply with state laws and local ordinances including Mammoth Lakes Fire Department Ordinance 2022-01 Section 308.1.4

Maintain safety, prevent fire hazards and ensure fairness across the HOA community.
Prohibition Against Using Specified Open Flame Devices on Combustible Balconies or Within 10’ of Flammable Structures
Prohibited Devices
The following are not allowed on Mammoth Estates balconies, or within 10 feet of combustible construction:

Charcoal burners

Wood barbeques
-
Any other open flame devices, except as permitted below.

Homeowners are responsible for removing any non-compliant barbeques or other non- compliant devices.
Permitted Devices
The following are allowed, subject to compliance with the manufacturer’s safety instructions and fire code:

Electric Grills

Enclosed pellet grills, and smokers. This means an enclosed, sealed combustion chamber which does not have an open flame.

Small portable barbeques or other cooking devices with a propane bottle weighing no more than one pound

Before using any of the permitted devices, the owner must complete the HOA Barbeque and Other Devices Safety Form and provide that form to the HOA manager.
Compliant devices may never be left unattended and must be turned off after each use.

Owner Responsibilities
HOA owners must notify, in writing, their guests, tenants and rental agency or rental service of these restrictions.
Owners are responsible for ensuring compliance by anyone using their unit.

Compliance with Laws
This Rule must be interpreted consistently with any local town, county, and state laws, and regulations. If there is a conflict, the applicable law will prevail.

Enforcement
The HOA may enforce these Rules through fines, or other lawful measures All fines or penalties will be the responsibility of the HOA owner.
Violations may also result in fines or enforcement actions by the Mammoth Lakes Fire Department.

Amendments
The HOA reserves the right to amend or modify these Rules as deemed necessary. All changes to the policy will be communicated to owners in writing.
